Terms

These terms apply when you use Festive Portrait Maker at www.festivecards.app and when you buy from us. Please read them with our Privacy notice and Refunds and cancellations policy. The version shown when you place an order applies to that order.

1. Who we are

Festive Portrait Maker is run by Hampton.io Ltd, a private limited company registered in England and Wales, company number 15728356. Our address is 139 Old Station Road, Hampton in Arden, Solihull, West Midlands, B92 0HE, United Kingdom. You can contact us at support@hampton.io.

2. Using the site

  • You can upload a photo and see watermarked previews for free.
  • You must be 18 or over to buy. Our products are for personal use by consumers.
  • We may change, pause or withdraw styles or features, and the site may sometimes be unavailable, for example for maintenance.

3. Your photos and what you may upload

You must only upload photos that you took or have the right to use. You must not upload anything that:

  • shows a child unless you are their parent or guardian or have their permission;
  • shows another person who hasn't agreed to you using their photo;
  • is sexual, violent, hateful, harassing, or illegal;
  • infringes someone else's copyright, trade mark or privacy;
  • is meant to deceive, for example to impersonate someone or create a fake image of a real person.

We may refuse to create, or remove, anything that breaks these rules, and block misuse of the site. You keep all your rights in your photos. You give us permission to use them, and the portraits made from them, only to run the service: to create previews and portraits, store them, show share pages and meet our legal duties. 4. AI-generated portraits

  • Portraits are created by artificial intelligence (Google's Gemini models) from your photo and the style you choose. Every result is different, and the likeness, colours, details and any text may not be exactly what you expect.
  • Look at the preview before you buy. The portrait you buy is the image in the preview, without the watermark.
  • Other customers who choose the same style may receive portraits that look similar in style. We can't promise that a portrait is unique or that it is protected by copyright.

5. Intellectual property and how you may use your portrait

The site, its styles, templates, watermarks and branding belong to us or our licensors. When you have paid for a portrait, we give you a permanent, non-exclusive licence, to the extent we hold rights in it, to use it for personal, non-commercial purposes: to print and frame it, send it as a card, give it as a gift and share it online. You may not sell it, use it in products or advertising for sale, or use it to train AI models without our written permission. Watermarked previews are only for deciding whether to buy.

6. Prices, payment and your contract with us

  • Prices are shown in your currency before you pay, including any taxes we have to charge.
  • Payment is taken by Stripe when you place your order.
  • Our contract with you starts when your payment is confirmed and we show your order confirmation page. We also email you a confirmation.
  • If we make an obvious pricing mistake, we will contact you before fulfilling the order and you can cancel for a full refund.

7. Digital downloads

  • Your download links appear on the order confirmation page and are emailed to you straight after payment. They work for 30 days, for up to 10 downloads each, so please save your files. If a link expires, email us and we will send a new one.
  • At checkout you ask us to supply your download straight away and accept that you lose your 14-day right to cancel once the download starts. Your rights if a download is faulty are explained in our Refunds and cancellations policy.

8. Our responsibility to you

  • If we break these terms, we are responsible for loss or damage you suffer that is a foreseeable result of it. We are not responsible for loss or damage that isn't foreseeable, or for business losses.
  • If a download we supply damages your device or other digital content because we didn't use reasonable care and skill, we will repair the damage or pay you compensation.
  • Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that can't be limited by law, and nothing affects your legal rights as a consumer. For advice about your rights, contact Citizens Advice.

9. Other important terms

  • We may update these terms. Changes don't affect orders you have already placed.
  • If a court decides part of these terms can't be enforced, the rest still applies.
  • These terms are governed by the law of England and Wales. You can bring a claim in the courts of England and Wales, or in Scotland or Northern Ireland if you live there. If you live in the European Union, you also keep the protection of the mandatory consumer laws of your country.
